PUBLIC OFFER

Regulatory Provisions.

The Civil Code of the Republic of Belarus (hereinafter referred to as the CC RB). Excerpts.

Article 405. Offer

1. An offer is an offer addressed to one or more specific persons, which is sufficiently definite and expresses the intention of the person who made the offer to consider himself as having entered into an agreement with the addressee who accepts the offer.

The offer must contain the essential terms of the contract.  

2. An offer binds the person who made it from the moment it is received by the addressee. If a notice of revocation of the offer is received earlier or simultaneously with the offer itself, it is considered not received.

Article 407. Invitation to make an offer

1. Advertising and other offers addressed to an indefinite circle of persons are considered as an invitation to make offers, unless otherwise expressly stated in the offer.

2. A public offer is an offer containing all the essential terms of the contract, from which it follows that the person making the offer intends to enter into a contract on the terms specified in the offer with anyone who responds.

 

2. General Provisions.

2.1. This document is a contract - a public offer of the Public Association "Belarusian Triathlon Federation", hereinafter referred to as the "Organizer", addressed to individuals and contains all the essential terms for the provision of services that are the subject of this contract.

2.2. In accordance with clause 2 of Article 407 of the CC RB, in case of acceptance of the following conditions and payment for services, an individual who accepts this Offer becomes a Participant (in accordance with clause 3 of Article 408 of the CC RB, acceptance of the Offer is equivalent to the conclusion of a contract on the terms set forth in the Offer), and the Organizer and the Participant together - the Parties to the public offer agreement.

2.3. In view of the foregoing, please read the text of this agreement carefully.

If you do not agree with any of the provisions of this agreement, the Organizer suggests that you refuse to use the services.

2.4. By concluding this agreement, the Participant confirms that he/she has read, understood, and agreed to all the rules included in this agreement, and accepts them unconditionally and in full.

2.5. The Organizer is responsible for the compliance of the information contained in this document with the current legislation of the Republic of Belarus, as well as with the actual circumstances. 
 

3. Subject of the Agreement

3.1. The subject of this agreement is the provision of services to an individual wishing to participate in the Sports and Mass Event "International Minsk Triathlon 2025" organized by the Organizer (hereinafter referred to as the Event), in the form of organizing and conducting the Event in the manner and on the terms provided for by this agreement, the regulations of the Event, including, but not limited to, services for registration as a Participant.

3.2. During the registration for the Event, the Participant, through a personal account registered on the website https://minsktriathlon.by/ (hereinafter also referred to as a personal account), has the right to purchase related goods and services (additional options).

3.3. The description of the Event, the characteristics of the Event, the main provisions of the Event, the rules for participating in the Event are specified in the Regulations of the Event, posted on the registration page, which the Participant must read during the registration for the Event.

3.4. Rules for online registration for the Event, carried out by the Participant through a personal account.

3.4.1. Registration is considered successfully completed upon full payment of the registration fee (hereinafter also referred to as the participation fee or starting fee).

Without payment, registration is automatically canceled after 1 calendar day.

3.4.2. In case the Participant refuses to participate in the Event, the participation fee is not refunded.

3.4.3. In case the Participant is not allowed to participate in the Event for any objective reasons, the participation fee is not refunded.

3.4.4. The distance of the paid registration for the Event can be changed until July 21, 2024, if there are free places. To change the distance, you must send a request to the email address info.blr.triathlon@gmail.com.

3.4.5. Changing the distance after the end of online registration and on the day of issuing starting packages to the participant is not possible.

3.4.6. A Participant who has registered to participate in the Event has the right to transfer (reissue) their right to participate in the Event to another person who is not registered for the Event, until July 21, 2024.

To transfer the registration, the registered participant must fill out an application and send it to the following address: info.blr.triathlon@gmail.com.

3.4.7. The paid registration for the Event is non-refundable, the registration fee is not refundable.

3.5. In case of cancellation of the Event due to the occurrence of extraordinary, unforeseen and unavoidable circumstances that could not have been reasonably foreseen, avoided or overcome, and which are beyond the control of the Organizer, the participation fee is not refunded.

In particular, such circumstances include: natural disasters (earthquake, flood, hurricane); wind gusts exceeding 15 meters per second (inclusive); air temperature below 15 or above 30 degrees Celsius (inclusive); other circumstances, events, phenomena that are recognized as emergencies and warn of their possible occurrence; fire; mass diseases (epidemics); strikes; military actions; terrorist acts; sabotage; restrictions on transportation; bans imposed by states; prohibition of trade operations, including with individual countries, as a result of the adoption of international sanctions; acts, actions, inaction of state authorities, local self-government; other circumstances beyond the control of the Organizer.

In the event of the occurrence or threat of the occurrence of the above circumstances, as a result of which the Event must be canceled, the Participant is notified by SMS to the phone number or by email to the email address specified during registration.

3.6. The Participant is obliged to independently monitor their health and undergo a medical examination for the presence of contraindications to prolonged physical exertion.

The Participant confirms that they have checked their health regularly, are physically fit to participate in the Event and have no contraindications to this.

By accepting the terms of this agreement, the Participant guarantees that he/she is in good physical condition, does not have any medical or other health restrictions that could endanger him/her or limit his/her participation in the Event, and his/her health condition allows him/her to participate in the Event.

The Participant of the Event does not object to being provided with first aid if necessary. 

 

4. Photo and video filming. Personal data

4.1. The Organizer carries out photo and video filming of the Event.

The Participant of the Event agrees to the use by the Organizer of the name, portraits, photographs or other audio, video, and photo materials obtained as a result of the Event, provided by the Participant himself, or obtained from publicly available sources, for advertising activities, for other purposes, subject to the restrictions established by regulatory legal acts, without limitation on the terms and places of use of these materials; the Organizer has the right to edit these materials and transfer them to third parties; the Participant has no right to demand any compensation from the Organizer.

4.2. The Participant is responsible for providing complete and accurate data about himself.

4.3. The Participant does not object to receiving from the Organizer or a person authorized by the Organizer, short text messages (SMS) or electronic mail (e-mail) with information about the Event, with other information concerning the Participant and related to the Event.

4.4. In accordance with Article 8 of the Law of the Republic of Belarus dated 07.05.2021 No. 99-Z "On the protection of personal data", the Participant, by filling out the registration form for participation in the Event and joining this agreement, gives his consent to the processing of his personal data by the Organizer.

The processing of personal data means any action (operation) or set of actions (operations) performed with the use of automation tools or without the use of such tools with personal data, including collection, recording, systematization, accumulation, storage, clarification (update, change), extraction, use, transfer (distribution, provision, access), depersonalization, blocking, deletion, destruction of personal data.

The processing of the Participant's personal data is carried out exclusively for the purpose of registering the Participant for participation in the Event and subsequently sending the Participant short text messages (SMS) or e-mail (e-mail) with information about the Event, with other information concerning the Participant and related to the Event.

The date of giving consent to the processing of the Participant's personal data is the date of sending the registration form to the Organizer via a personal account. The consent is valid for 5 (five) years from the date of transfer of personal data.

The consent to the processing of personal data can be revoked by the Participant by sending the Organizer a written statement in free form to the email address info.blr.triathlon@gmail.com about the revocation of consent to the processing of personal data.
